How First Step Act credits are earned

  • Credits accrue in completed 30-day periods of successful participation in evidence-based recidivism reduction programming or productive activities.
  • Most eligible participants earn 10 days per 30-day period.
  • Participants at minimum or low PATTERN risk who have maintained that level over two consecutive assessments earn an additional 5 days, for 15 days per 30-day period.
  • Partial periods do not carry over — only completed 30-day blocks count.

How the credits are used

  • Up to 365 days of earned credits may be applied to advance the release date to supervised release.
  • Credits earned beyond that cap are applied toward additional prerelease community placement.
  • Offenses listed in 18 U.S.C. § 3632(d)(4)(D) are disqualified from applying FSA credits, though a person may still earn them.
